Blogger is Silenced With Lawsuit – Help Him Fight

While this topic is not exactly WordPress related it deals directly with our ability to write. Freedom of speech defined in US Constitution means nothing to some corporations who find that it is easier to get a blogger silenced by a threat of lawsuit. Even if they have to follow through with that frivolous lawsuit - it is a drop in the bucket from them, which a HUGE financial burden for 99.9% of the bloggers!
If you think it will never apply to you - think again! Anytime you write an article and share your opinion you are painting a target on your own back and it is only a matter if anyone willing to hit it or not. But time might come when they will! Learn how you can help fellow blogger who is in this position right now!
There is a long story behind the entire issue and different opinions on each side.
I have always personally believed that ePerks have taken a personal attack on blogger and decided to smear his name with dirt. When they have failed to accomplish it - they filed lawsuit to silence him!
Now he is getting ready for a court appearance and hopefully defend himself against it but he needs our help! Defense cost money, and lawsuit defense cost a lot of money - you can help out by doing a small donation or by spreading the word!

Lawsuits like this really upset me. These companies know that they can bully most people into submission. I applaud him for standing up. A similar thing happen to a realtor i know. He blogged about a builder in in his area. The builder decided to sue him.

it really is a david and goliath type struggle, since the company has a vast pool of funds and resources to tap, while the blogger is mostly on his own.

Yes there is Freedom of Speech, the Constitution Protects it. Many people use that term and think they have an open invitation to say what you want. Not true.
You cannot defame someone without proof. Now if what was written about eperk.com is true (truth is a defense to defamation) there isn’t much eperks can do.
I’m sure your attorneys have it under control.
WIth that said I will not be donating to the cause.

Jim,I don’t have any legal issue with eperks or otherwise. If you have read the article - I stated that is was about a case that someone I know is fighting. I agree that freedom of speech doesn’t mean uncontrolled verbal diarrhea and I fully support other people’s opinions.
This post is about WHAT I PERSONALLY believe, based on information I have read and accessed, a corporation trying to silence blogger for not playing the game by the rules they wanted to define and choosing legal method as one that will be most expensive for that blogger in hopes it will force him to comply. It is a case of underhanded strategies against someone like me.
There are many opinions on who is right and wrong in that case and I thank you for expressing your personal opinion - I just wish you would have actually read the information referenced and the post itself. Quite frankly I don’t know anything about the eperks outside the details shared by multiple blogs on the specific issue as it pertains to the Vlad. I also have no opinion OR issues with their business model as I have no clue what it is. I only read details on how they handled the case with Vlad and obviously express my PERSONAL and BIASED opinion on that.

just to follow up one what was said above, i think that one of the issues that looms large here, aside from free speech, is how the internet will be run. the beauty of the internet is that it gives an individual the avenue to express his opinion in such a way that it can reach a global audience.
the question is, how will large entities such as corporations, and governments react to this? and whenver i hear about a blogger being subjected to a lawsuit, i fear that more of that will lead to an era where the ability of an individual to give voice to his thoughts online will be lost, precisely because of the fear of litigation. self censorship may end up prevailing.
such lawsuits tend to be a mere drop in the bucket for a huge corporate entity. for the individual blogger though, it can wreck him financially, even if he is later found to be innocent.
again, i’m not commenting on any one particular case, but on the possibility of a trend taking root.

You cannot defame someone without proof. I don`t know about the states but here in Holland where Freedom of speech is highly regarded it is an imprisonable offence… and any blogger should just stay away from that path unless it is evedent.
