Email Affiliate Disclosure Freebie You Must Have
Affiliate Marketing can be a reason for legal action against you, whether you agree with new FTC “guide” or not, it is here to stay. In this post I simply want to share a resource that gives you an option to add Affiliate Disclosure to your email marketing campaigns.
I just got it myself from Mike Young and will be working on integrating it into my email marketing.
Simply click here to download *.zip archive that has the PDF with exact legal language you can use in your Affiliate Emails as Disclaimer.

Technorati: affiliate disclaimer, affiliate-marketing, email marketing, internet marketing, legal,

The FTC decision sounds very much like a lot of the politcal discussions going on these days. For example, the German government is planning some legislation which would put Internet access control in place or to control when Tweets can be sent on political decisions. You get the impression that politians the world over have very little knowledge on what the Internet is all about and they are trying to control it somehow.
We will have to wait and see how the changes the FTC has put through will effect the net. Of course, over here in Europe we have enough of our own legislation to consider, without having to comply with yours.

Hey Alex.
How does the FDA effect bloggers that don’t live in the states? Can they still fine you? Or does this only effect US bloggers. I like how the wheels are in motion to clean up the web, I just wonder how much control Government will try and take, I heard they are already blocking certain pages.

Matt,
Sorry, I simply don’t know and don’t have legal knowledge to answer your question.
I think this whole ftc regulation is plain stupid, these guys don’t browse the web much for sure. I think the disclaimer text is very well done, and I thank you for it, it can easily be adapted to change the word email to website.
Even if I am living in Europe and the ftc probably doesn’t apply to me I will add the disclaimer on my sites, even if I think it is stupid and probably only contains common sense since I do not know much bloggers who don’t benefit from te links they are giving away. Any professional should do and I don’t undestand why newspaper don’t use them more often. When I speak about a book I always add a look to my amazon affiliate page, this doesn’t mean that I only do it for money good sack, and if I promote a clickbank product it is because other customers enjoyed it. IT is normal that I send people through a link that pay’s me, otherwise I wouldn’t probably speak about it at all..

The one question I am not getting a definitive answer on is whether a link to material connection disclosure will suffice or if the disclosure is required in each piece of content provided. From what I am reading of the FTC requirements, it will be the later. Until I know more, I have added a stripped down bit using this email disclosure as a guide, to the comments module in Wordpress to automate its inclusion. I don’t believe, at this time, that the intent of the FTC is covered with a statement in the footer, even if it contains a link to a expanded explanation.

I agree. No matter how much I disagree with the FTC about what their job actually is, it is always better to have your hind end covered. This disclaimer looks like it covers mine.
I have a stupid question: If you are buying through your own affiliate link, do you have to inform yourself or are assumed to know that your own link is an affiliate link and that you will be compensated for the sale? One has to wonder whether there actually is a regulation to cover that one. After that would fall under micro-managing the minutia of our lives. Apparently that is what the government is all about.
Kinda makes you wonder why they even keep a copy of the Constitution around, doesn’t it?
I suppose that there are surfers out there that are not aware that affiliate offers exist or that some marketers will recommend anything that will pay them.
Thanks for the freebie!

the recent FTC guide that has come out, is really going to hurt A LOT of different affiliate marketing business models. especially the one rule that there has been a lot of buzz about, no review style sites, which was what a lot of the big gurus used to make there living(or so they say…
)
well, nice post.
thanks

It is sad that the hackers, virus postal services and others are not “policed” more effectively.
But the law, being the law, we will all have to try to comply. A clean business is a good business.
Why are templates not supplied free of charge by the FTC? Or a good outline of what the requirement is for all to see and use, without people don’t have to pay for it.
FTC law affects everyone online irrespective of where in the world you live – you will end up dealing with the USA.
Thanks for the assistance on your site.
